From breaking to broken: The                     success & failure                              of Breaking Benjamin                       


A chronology of the Wilkes-Barre band's rise and the infighting that has left it in shambles, based on court documents, news archives, the band's official website and recording industry data:

1998: Lead singer Benjamin Burnley forms Breaking Benjamin in Wilkes-Barre with Aaron Fincke (known by his stage name Aaron Fink), Nick Hoover and Chris Lightcap.

1999: After a stint performing in California, Burnley returns to Wilkes-Barre and forms Plan 9 with drummer Jeremy Hummel.

2000: During a Plan 9 performance, Burnley rechristens the band "Breaking Benjamin." Fincke, who had joined the band Lifer, returns to the band. Mark Klepaski (who performs as Mark James) joins the band from the group Strangers With Candy.

July 16, 2002: First single, "Polyamorous," debuts. It reaches No. 19 on the Billboard U.S. Hot Mainstream Rock chart and No. 31 on the U.S. Hot Modern Rock Tracks chart.

Aug. 27, 2002: Debut album, "Saturate," is released. It ranks No. 2 on the Billboard Top Heatseekers chart and No. 136 on the U.S. Billboard 200.

Feb. 18, 2003: Second single, "Skin," premieres. It reaches No. 37 on the Billboard U.S. Hot Modern Rock Tracks chart and No. 24 on the U.S. Hot Mainstream Rock Tracks chart.

March 14, 2003: Within a three-week span, the band performs "Skin" on "Last Call with Carson Daly" and "The Late Late Show with Craig Kilborn."

March 30, 2004: "So Cold," the first single from the band's second album, debuts. It hits No. 2 on the Billboard Mainstream Rock Tracks chart, No. 3 on the Modern Rock Tracks chart and No. 76 on the Billboard Hot 100.

June 29, 2004: The band releases its second album, "We Are Not Alone." It ranks No. 20 on the Billboard 200 and attracts a following in New Zealand, where it landed as the No. 14 most popular album in 2005.

Sept. 7, 2004: Burnley fires original drummer Jeremy Hummel while Hummel is on band-approved leave to be with his wife after the birth of their first child. Hummel is first replaced by Ben Vaught and then by Chad Szeliga.

Sept. 28, 2004: A second single from the album, "Sooner or Later," is released and reaches No. 2 on the Billboard Mainstream Rock chart, No. 7 on the Alternative Songs chart and No. 99 on the Billboard Hot 100.

Nov. 23, 2004: The band releases "So Cold EP," an album of five live performances and two studio tracks, including "Blow Me Away" - the root of the band's recent turmoil.

April 8, 2005: The band appears on "The Tonight Show with Jay Leno" and performs "Sooner or Later."

Sept. 26, 2005: Hummel files a federal lawsuit against Burnley, the other band members and the band's manager, accusing them of wrongful termination.

April 14, 2006: Hummel's lawsuit is settled for an undisclosed amount.

June 6, 2006: "The Diary of Jane," a single from the band's third album debuts. It is reportedly the fastest singled added to radio playlists in the history of Hollywood Records and is the only Breaking Benjamin song ever to place on the Billboard Pop 100 (No. 46). It also peaks at No. 2 among Mainstream Rock Tracks, No. 4 among Modern Rock and Alternative Songs and No. 5 on the Billboard Hot 100.

Aug. 8, 2006: Third album, "Phobia" released and reaches No. 2 on the Billboard 200, No. 1 on the Top Rock Albums and Top Internet Albums of 2006.

Jan. 21, 2007: Second single from "Phobia" is released. "Breath" spends seven weeks at No. 1 on the U.S. Billboard Mainstream Rock Tracks chart.

Oct. 2, 2007: "Until the End" debuts as the third single from "Phobia" and peaks at No. 6 on the Billboard Mainstream Rock Tracks chart.

Sept. 29, 2009: The band's fourth and most recent original studio album, "Dear Agony," is released.

Feb. 16, 2010: "Dear Agony" sells more than 500,000 copies and is certified Gold by the RIAA.

March 10, 2010: Hollywood Records requests the band produce two new master recordings and seeks permission to release a new version of the hit song "Blow Me Away" with new vocals by Sydnee Duran of the band Valora.

June 1, 2010: Burnley says he is ill and no longer able to perform live in support of the "Dear Agony" album.

June 3, 2010: The band cancels a performance in Vancouver, B.C. On its website, shallowbay.com, the band states the cancellation is "due to illness."

June 29, 2010: Burnley posts a message on the band's website dispelling "Internet rumors" of its demise: "I am officially letting everyone know that Breaking Benjamin has NOT broken up!"

July 26, 2010: The last message is sent from the band's official Twitter.com account, @breakingbenj. It promotes a Breaking Benjamin song pack available for the video game "Guitar Hero."

May 13, 2011: Fincke and Klepaski give Hollywood Records retroactive permission to record a new version of "Blow Me Away" after the company offers a $100,000 payment, according to Burnley's court filings.

May 15, 2011: Burnley fires Fincke and Klepaski from the band via e-mail.

June 6, 2011: Burnley through his attorneys, files court papers outlining his allegations against Fincke and Klepaski and demanding at least $750,000 in compensatory and punitive damages.

July 29, 2011: Luzerne County Judge William H. Amesbury rejects Fincke and Klepaski's request to have the matter handled in court, sending the case to arbitration.

Aug. 2, 2011: The Citizens' Voice reports on the band's infighting. The Associated Press picks up the story, propelling it onto news and entertainment websites across the world and fueling reaction from fans dismayed by the band's apparent demise.

Aug. 16, 2011: Hollywood Records is scheduled to release "Shallow Bay: The Best of Breaking Benjamin," a greatest hits compilation featuring the remixed and re-recorded version of "Blow Me Away" at the heart of the band's current strife

Man in my Dreams

Well today im officially 22 years old. The biggest wish that i would ask for is to have Benjamin Burnley singing at my birthday party! That would just be amazing!

ANY TIME NOW!

I wish they would hurry up with the legal situation happening with Benjamin. im suffering without new music from him. I have checked many websites and still no updated news about Breaking Benjamin or Benjamin Burnley. If you have seen any updated stuff please post it on here!
